General Terms and Conditions of Sale of Aphrodite Love Store

1. Purpose

These general terms and conditions of sale govern the contractual relationship between the customer (hereinafter referred to as "the Customer") and the company "Aphrodite Love Store" (hereinafter referred to as "the Seller") in the context of purchasing products from the online store.

2. Products

The products offered for sale by Aphrodite Love Store are those listed on the website at the time of the Customer's consultation. Our gold-plated items are made on a base of brass, stainless steel, or copper. The deposited gold is 24-carat gold with a guaranteed minimum thickness of 3 microns and no dispersion. All our gold-plated items are marked with our logo as well as a serial number. The serial number can be found on the authenticity card delivered with the item. All our products are guaranteed to be new. The essential characteristics of the products and their respective prices are available on the Aphrodite Love Store website. The Customer acknowledges having read the pre-contractual information related to each product before placing an order.

The products offered comply with the applicable French legislation and standards. The photographs, texts, graphics, information, and characteristics reproduced and illustrating the products presented are contractual.

3. Product Warranty

All our gold-plated items are guaranteed for 1 year (only the plating) against any manufacturing defects related to normal use. In any case, the legal warranty against hidden defects applies. To benefit from the product warranty, it is essential to keep the purchase invoice and notify us within 3 business days following the receipt of your package.

4. Orders

The ordering process is detailed on the Aphrodite Love Store website. The Customer is responsible for providing accurate and complete information when placing an order. Order validation constitutes acceptance of these general terms and conditions of sale.

However, we reserve the right to refuse orders that do not meet all authenticity guarantees or that do not comply with the sales conditions. Any order can be canceled by simple request from the Customer by email or telephone before shipment. We cannot be held responsible for a cancellation request received after shipment, and customized items as well as shipping and preparation fees will not be refunded.

5. Prices and Payment

The product prices are indicated in euros, all taxes included (current VAT rate of 20.00%). The price of an item does not include processing and shipping fees, which may be charged in addition to the sale price. Order payments must be made in euros and for the amount indicated at the time of order placement (any additional costs are the responsibility of the Customer). Aphrodite Love Store reserves the right to modify prices at any time while ensuring the Customer benefits from the price applicable at the time of order validation.

6. Invoicing

Any validated order will generate an invoice, which will include VAT (for deliveries in France), shipping costs, and other applicable fees. The invoice will be issued in euros under the name provided at the time of order placement and will be included in the package. It serves as proof for the start date of warranties. Invoices will include VAT for private customers in Metropolitan France, Corsica, Monaco, and the European Union, and be tax-free for all other destinations or professional clients (excluding Metropolitan France, Corsica, and Monaco). For deliveries to French overseas territories, the invoice will be tax-free in euros.

7. Delivery

Delivery times and fees are indicated during the order process. Aphrodite Love Store commits to delivering products within the announced time frame, except in exceptional circumstances.

Orders will only be shipped after full payment has been received. Orders are prepared within 0 to 5 business days (on average 2), excluding transportation. You will receive an email notification upon shipment. Items and their invoices are delivered to the address provided by the Customer at the time of order. The provided address must be complete and accurate. Any change to the delivery address after placing an order can only be made by email before shipment. Late changes will not be considered, and any related costs will be at your expense.

The available carriers depend on the chosen destination country. For shipments outside the European Union, additional taxes may be charged upon receipt. These taxes vary by country and remain at your expense (regardless of shipping fees paid on our site). We cannot inform you of the exact amount. Similarly, for shipments to French overseas territories, customs fees (overseas tax) will be due upon receipt of your package, even in the case of free shipping.

All shipments are tracked and require a signature upon delivery. Tracking is available in the "My Orders" section of our website once you log into your account.

8. Right of Withdrawal

In accordance with Article L221-18 of the Consumer Code, the Customer has a 14-day withdrawal period from the receipt of products to exercise their right of withdrawal. Return shipping costs are the responsibility of the Customer unless the product is defective.

The withdrawal period expires fourteen days after the day you, or a third party other than the carrier designated by you, take physical possession of the last item.

To exercise the right of withdrawal, you must notify us of your decision through an unambiguous statement (e.g., a letter sent by post or email) at Aphrodite Love Store, 1 Rue Nivoy - 54530 Pagny-Sur-Moselle, France, or by email at contact@aphroditelovestore.com.

Exceptions to the right of withdrawal:

Products made according to the consumer's specifications or clearly personalized
Products likely to deteriorate or expire quickly
Products unsealed by the consumer after delivery that cannot be returned for hygiene or health protection reasons

This right of withdrawal does not apply to professional clients, and Aphrodite Love Store reserves the right to refuse withdrawal requests from clients ordering through a business account.

9. Guarantees

Products sold by Aphrodite Love Store benefit from the legal guarantee of conformity and the guarantee against hidden defects in accordance with Articles L217-4 and following of the Consumer Code.

10. Customer Service

For a return under warranty, after acceptance by our services, the Customer must include a copy of the invoice in the package. Repair times range from 1 to 6 weeks (upon receipt of the package) and may vary based on the repair and item origin. Return shipping fees are at the Customer's expense, while the return fees after repair are covered by Aphrodite Love Store in case of a proven defect.

11. Personal Data Protection

Aphrodite Love Store is committed to protecting its customers' privacy. Collected personal data is used solely for order management and is protected in accordance with applicable regulations, including the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR).

12. Disputes

In case of a dispute, the Customer may use a consumer mediation procedure or any other alternative dispute resolution method. Failing an amicable resolution, the competent French courts will be seized.

13. Applicable Law

These general terms and conditions, written in French, are subject to French law. For professionals, any dispute shall be under the exclusive jurisdiction of the Commercial Court of Nancy (54). Online sales on the site are governed exclusively by French law.

14. Modification of Terms and Conditions

Aphrodite Love Store reserves the right to modify its general terms and conditions of sale at any time. The applicable terms are those in effect at the time the Customer places an order.
